These Terms & Conditions outline how our tours operate and what you can expect when traveling with TourMagination. They include important information regarding bookings, payments, cancellations, and responsibilities.

By registering for a tour, you agree to these Terms & Conditions. We encourage you to review them carefully before confirming your trip.

1. Agreement & Acceptance

By registering for and participating in a TourMagination tour, you (“Traveler”) agree to be bound by these Terms & Conditions of TourMagination Inc. (“TourMagination”). Acceptance occurs upon submission of registration and/or payment of any deposit. 

2. Booking & Payment

A deposit is required to confirm your reservation. Final payment is due by the date specified on your invoice. 

Failure to make payments by the due date may result in cancellation of your booking and forfeiture of any amounts paid. 

3. Cancellation & Refund Policy 

A non-refundable cancellation fee of $300 per person applies to all cancellations. 

Cancellations received 121 days or more prior to departure will receive a refund of amounts paid, less applicable fees. 

Cancellations received 120 days or fewer prior to departure are 100% non-refundable. 

Additional supplier fees may apply and may be non-refundable. 

All cancellations must be submitted in writing. 

4. Tour Cancellation by TourMagination

TourMagination reserves the right to cancel a tour prior to departure. 

Low Enrollment

If a tour is cancelled by TourMagination due to insufficient enrollment, travelers will receive a full refund of all amounts paid

External Factors

TourMagination will always seek to make decisions in the best interest of traveler safety and experience; however, certain circumstances may require changes or cancellation of a tour. 

These circumstances may include, but are not limited to, safety concerns, government advisories, political instability, natural disasters, or other unforeseen events. 

In such cases: 

  • Refunds will be provided less any non-refundable costs incurred from third-party suppliers, or  

  • A future travel credit may be offered at TourMagination’s discretion  

TourMagination is not responsible for additional expenses incurred by the traveler. 

5. Changes & Substitutions 

TourMagination reserves the right to make changes to itineraries, accommodations, transportation, or tour components where necessary. 

Travelers may request substitutions or transfers, which may be permitted at TourMagination’s discretion and may be subject to administrative and supplier fees.

6. Travel Insurance 

Travel insurance, including emergency medical coverage, is strongly recommended for all travelers. 

Travelers are solely responsible for obtaining appropriate insurance coverage, including coverage for medical emergencies, cancellation, and interruption. 

TourMagination does not provide insurance and is not responsible for the availability, adequacy, or performance of any insurance coverage purchased by the traveler. 

TourMagination is not liable for any medical, cancellation, or travel-related costs incurred by the traveler, regardless of whether insurance coverage is purchased. 

7. Responsibility & Third-Party Suppliers 

TourMagination Inc. acts solely as an intermediary in arranging transportation, accommodations, and other travel services provided by independent third-party suppliers. 

TourMagination does not own, operate, or control these suppliers and is not responsible for their acts, omissions, or performance. 

All services are subject to the terms and conditions of the respective suppliers. 

8. Limitation of Liability

To the fullest extent permitted by law, TourMagination Inc. shall not be liable for any injury, illness, death, loss, damage, delay, inconvenience, or financial loss arising from: 

  • acts or omissions of third-party suppliers  

  • accidents or incidents during travel  

  • circumstances beyond TourMagination’s reasonable control  

  • traveler negligence or failure to follow instructions  

In no event shall TourMagination’s liability exceed the total amount paid by the traveler for the tour. 

9. Assumption of Risk

Travel involves inherent risks, including but not limited to: 

  • physical activity (e.g., walking, hiking)  

  • transportation risks  

  • environmental conditions  

  • unfamiliar locations and standards  

By participating in a tour, travelers voluntarily assume all risks associated with travel and participation. 

10. Travel Risk Acknowledgment 

Travel to international destinations may involve varying degrees of risk, including political, environmental, health, or safety conditions that differ from those in North America. 

Travelers acknowledge that certain destinations may be subject to government travel advisories or warnings at the time of travel. 

TourMagination will always seek to make decisions in the best interest of traveler safety and experience; however, travelers understand that participation in a tour is voluntary and that conditions may change before or during travel. 

By registering for a tour, travelers acknowledge that they have reviewed available information regarding their destination, including any applicable travel advisories, and accept the risks associated with travel. 

Travelers agree that TourMagination is not responsible for losses, damages, or expenses arising from such risks.

11. Health & Fitness

Travelers are responsible for ensuring they are physically and medically fit to participate in the tour. 

TourMagination reserves the right to decline or remove any traveler whose condition or behavior may pose a risk to themselves or others. 

12. Travel Documents & Entry Requirements

Travelers are responsible for obtaining all required travel documents, including passports, visas, vaccinations, and entry permits. 

Entry into any country is at the discretion of local authorities, and TourMagination is not responsible for denied entry. 

13. Pricing & Adjustments 

TourMagination reserves the right to adjust prices due to factors beyond its reasonable control, including currency fluctuations, fuel surcharges, or supplier cost increases. 

No price increases will be made after full payment has been received, except where required by law or government-imposed charges. 

14. Force Majeure 

TourMagination shall not be liable for failure to perform its obligations where such failure is due to events beyond its reasonable control, including natural disasters, acts of government, war, civil unrest, pandemics, or transportation disruptions. 

In such cases, refunds or credits will be subject to supplier terms and recoverable amounts. 

15. Conduct & Participation

Travelers are expected to conduct themselves in a respectful and responsible manner. 

TourMagination reserves the right to remove any traveler whose behavior is disruptive, unsafe, or negatively impacts the group, without refund. 

16. Photography & Marketing

TourMagination may use photographs or video taken during tours for promotional purposes. 

Travelers who do not wish to appear in such materials must notify TourMagination in writing prior to departure. 

17. Governing Law

These Terms & Conditions are governed by the laws of the Province of Manitoba and the laws of Canada. 

Any disputes shall be resolved in the courts of Manitoba, Canada. 

18. Severability 

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
